A woman from the Republic of Karelia went to court against the regional branch of the Social Fund of the Russian Federation, seeking payment of the monthly allowance related to the birth and upbringing of a child and compensation for moral damage in the amount of 50,000 rubles. Earlier, the Pension Fund had refused to pay the allowance, citing incomplete information in the application, and later awarded only half of the child subsistence minimum. The court of first instance partially granted the claim, ordered the defendant to pay the allowance in full, and refused compensation for moral damage, finding that only the plaintiff’s property rights had been violated. The appellate and cassation courts agreed. The Supreme Court of Russia, reviewing the cassation complaint, stated that the lower courts had incorrectly applied the provisions of the Civil Code of the Russian Federation and the explanations given in Plenum Resolution No. 33 of 15 November 2022 on compensation for moral damage, and had also failed to take into account the purposes of state social support for citizens with children. The defendant had underpaid the social benefit, which caused the applicant emotional suffering, since it affected her family’s financial situation. The courts approached the case formally, did not assess the plaintiff’s explanations, and did not request evidence of the emotional suffering caused to her. The case was sent for a new hearing.
